These Terms of Use govern, together with the Privacy Policy, your use of the Acupuncture Assistant and Guia de Homeopatia mobile applications (the "Applications") and related services provided by TCM Points ("Us", "We"). By using the Applications, you accept and agree to these Terms and Conditions ("Terms"). Therefore, it is important that you carefully read through these Terms. If you do not consent to these Terms, you should not use the Applications.

We may share anonymous usage data with trusted third parties, such as Google Analytics, Google Firebase, and Google Ads. Your data may be stored and processed on servers located outside your country of residence, including in the United States, through Google Firebase infrastructure. By using the Applications, you consent to this international data transfer.
If you choose to log in to the app, we will collect and store your email address on our secure cloud server. Your email is only used for authentication purposes. It will never be sold, shared, or used for any other purpose without your explicit consent.
The Applications offer optional premium subscriptions ("Pro") that unlock additional features. Subscriptions are processed entirely by the respective app store platform (Google Play or Apple App Store) and are subject to their payment terms.
The Applications include an AI-powered assistant feature. Please read the following carefully before using it:
Notes and annotations you create within the Applications remain your property. By storing them in our infrastructure (Google Firebase), you grant us a limited, non-exclusive, and revocable license to process and store this content solely for the purpose of providing the service to you. We do not use your personal notes for marketing, AI training, or any other purpose.
Upon account deletion, your content will be removed from our servers within 30 days. To request account deletion, use the Settings tab within the app.
We may update this Privacy Notice from time to time to reflect changes in our practices or for other operational, legal, or regulatory reasons. You are advised to review this Privacy Notice and Terms of Use periodically for any changes. Changes are effective when they are posted on this page. If the changes are significant, we may provide more prominent notice or obtain your consent as required by law. We will not change this agreement to allow the collection of private data or make other significant changes without your consent.

The Applications are intended for users aged 18 years or older. We do not knowingly collect personal data from individuals under the age of 18. If we become aware that data has been collected from a minor, we will promptly delete it.
On iOS devices, we may request permission to track your activity across other apps and websites for advertising purposes, as required by Apple's App Tracking Transparency (ATT) framework. Your choice is respected entirely and does not affect the core functionality of the Applications.
All rights in and to the Services, including any trademarks, service marks, trade names, and copyrighted content (collectively "Intellectual Property") presented within the Applications are the property of TCM Points. You agree not to use Intellectual Property for any other purposes except for your use of the Service unless required otherwise by applicable mandatory law.
The Applications are not medical devices and are not intended to be used as such. They should not be used to diagnose, treat, or prevent any disorder or medical condition. The Applications are meant to be used by professionals and not general users. If you are not a professional, always seek the advice of qualified medical staff before making any healthcare-related decisions. The content provided in the Applications is based on publicly available books from renowned authors.
We make no guarantees as to the suitability of this app for the user, or for any of its functionality, product price, accuracy, or usefulness. We reserve the right to change this app or to stop offering it. We will not be held responsible if this app is discontinued, changed, or otherwise made unusable and if data is damaged or lost as a result, or if the device itself is damaged, or if the device incurred damage due to another app.
The Applications and all of their content are provided on an "As Is" and "As Available" basis. We do not provide any assurances of the availability or usability by you of the Applications. We shall not be liable for any errors in any content or for any actions taken in reliance thereon. Furthermore, we shall not be liable to you for any interception of online communications, software or hardware problems (including, without limitation, viruses, loss of data, or compatibility conflicts).
We reserve the right to suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or use the Applications for illegal purposes, without prior notice. You may also request the deletion of your account at any time through the Settings tab in the app.
These Terms are governed by the laws of the Federative Republic of Brazil. The courts of BrasÃlia, Federal District (Distrito Federal), Brazil, shall have exclusive jurisdiction to resolve any disputes arising from or related to these Terms, and you hereby waive any objection to such jurisdiction.
